Welcome to Trailblazer Tours LLC ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website (trailblazertours.site), mobile applications, and our guided outdoor tours, excursions, and services (collectively, the "Services").

By accessing or using our Services, or by booking a tour with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services or book our tours.

1. Eligibility and Physical Fitness

By booking a tour or using our Services, you represent and warrant that:

• You are at least 18 years of age, or you are booking on behalf of a minor as their parent or legal guardian.
• You and all members of your booking party possess the physical fitness, health, and skill level required for the specific tour or excursion you have selected.
• You will disclose any relevant medical conditions, allergies, or physical limitations to us prior to the start of any tour. We reserve the right to decline participation to anyone we deem physically unable to complete a tour safely.

2. Bookings, Payments, and Cancellations

Bookings: All bookings are subject to availability and confirmation. A booking is only confirmed once we issue a confirmation email and receive the required payment.

Payments: You agree to pay all fees and charges associated with your booking. All prices are in US Dollars (USD) unless stated otherwise. Payments are processed securely via our third-party payment processors.

Cancellations & Refunds: Our cancellation policy is designed to be fair to both our guests and our guides. Cancellations made more than 7 days prior to the scheduled tour start time will receive a full refund. Cancellations made between 2 and 7 days prior to the start time will receive a 50% refund. Cancellations made less than 48 hours prior to the start time, or "no-shows," are non-refundable. If we cancel a tour due to severe weather or safety concerns, you will receive a 100% refund or the option to reschedule.

3. Code of Conduct and Safety

During any guided tour or excursion, you agree to:

• Strictly follow all instructions, safety briefings, and directions given by our guides.
• Respect local laws, wildlife, and the environment. We strictly enforce Leave No Trace (LNT) principles.
• Refrain from any behavior that is disruptive, dangerous, or harmful to yourself, our guides, other guests, or the environment. We reserve the right to terminate participation immediately, without refund, for anyone violating this code of conduct.

4. Assumption of Risk and Waiver of Liability

PLEASE READ THIS SECTION CAREFULLY. OUTDOOR ADVENTURES AND WILDERNESS EXCURSIONS INVOLVE INHERENT RISKS.

By participating in our tours, you acknowledge and agree that outdoor activities (including but not limited to hiking, trekking, skiing, snowshoeing, and high-altitude travel) involve inherent risks, dangers, and hazards, both known and unknown. These risks include, but are not limited to: severe weather changes, steep or uneven terrain, rockfalls, avalanches, wildlife encounters, physical exertion, altitude sickness, and accidents.

You voluntarily assume all risks associated with your participation in our tours. To the maximum extent permitted by applicable law, you release, waive, and hold harmless Trailblazer Tours LLC, its officers, employees, guides, and agents from any and all liability, claims, demands, actions, or causes of action arising out of any injury, illness, death, property damage, or loss suffered during or in connection with our tours.

5. Intellectual Property

All content on our website and mobile applications—including text, graphics, logos, images, software, and trademarks—is the property of Trailblazer Tours LLC or its content suppliers and is protected by United States and international copyright and intellectual property laws. You may not copy, reproduce, or distribute any content without our prior written consent.

6. Governing Law

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of the State of Utah, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Summit County, Utah.
